These Terms of Service (“Terms”) govern your use of mcnealystudios.com and the services provided by McNealy Studios Co. (“McNealy Studios,” “we,” “us,” or “our”). By using our site or engaging our services, you agree to these Terms.

Our services

McNealy Studios provides creative services including web design and development, branding, graphic design, social media, AI solutions, and apparel and print production. Specific deliverables, timelines, and fees for any project are defined in a separate proposal, quote, or agreement, which together with these Terms govern that engagement.

Quotes, orders, and payment

  • Quotes are valid for the period stated and may be revised if the project scope changes.
  • Work generally begins after a signed agreement and any required deposit are received.
  • Fees, deposits, and payment schedules are set out in your project agreement or order.
  • Late or missed payments may pause work and delay delivery.

Project process and approvals

Our work depends on your timely input. You agree to provide the content, materials, feedback, and approvals we need to complete your project. Revision rounds included in your engagement are specified in your agreement; additional revisions or scope changes may incur extra fees. Once you approve a deliverable, proof, or print file, it is considered final.

Customer-supplied artwork and printing

If you supply artwork for printing or production, you are responsible for ensuring you have the rights to use it and that files meet our stated requirements (format, resolution, color mode, and bleed). We are not responsible for errors present in files you approve, including spelling, layout, or low-resolution issues. Because of the nature of printing, minor variations in color, placement, and finish may occur between screen previews, proofs, and final printed products; such variations are not considered defects.

Intellectual property

Upon full payment, ownership of the final deliverables created specifically for you transfers to you, except for any third-party assets (such as fonts, stock imagery, or licensed software) and our own pre-existing tools, templates, and know-how, which remain subject to their respective licenses and our ownership. Unless you request otherwise in writing, we may display completed work in our portfolio and marketing.

Appointments

Appointments booked through our site are subject to availability and confirmation. Please contact us as early as possible if you need to reschedule or cancel. Repeated missed appointments may affect future scheduling.

Acceptable use

You agree not to use our site or services to upload unlawful, infringing, or harmful content, to interfere with the site's operation, or to attempt unauthorized access to our systems. We may refuse or discontinue service for conduct that violates these Terms or applicable law.

Warranties and disclaimers

We provide our services with reasonable skill and care. Except as expressly stated in a written agreement, our site and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, McNealy Studios will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of our site or services. Our total liability for any claim relating to a project will not exceed the amount you paid us for that project.

Third-party services and links

Our site and services may rely on or link to third-party providers and websites we do not control. We are not responsible for their content, availability, or practices, and your use of them is at your own risk and subject to their terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Palm Beach County, Florida.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of our site or services after changes take effect means you accept the updated Terms.
